1. Introduction

Welcome to Topsoil Tippers. By using our website and services, you agree to comply with and be bound by these Terms and Conditions. Please read them carefully before placing an order.

These Terms and Conditions incorporate by reference our Shipping Policy, Returns & Refund Policy, and Privacy Policy, which collectively form the entire agreement between you and Topsoil Tippers.

2. Privacy & Data Protection

  • We are committed to protecting your personal information in accordance with the Protection of Personal Information Act (POPIA).
  • By using our website and placing an order, you consent to the collection, use, and sharing of your data as strictly outlined in our full Privacy Policy.

3. Products and Services

  • We supply topsoil, compost, aggregates, sand, and stone in bulk and standard quantities.
  • Product descriptions and images are for reference only. Due to the natural characteristics of our bulk products, minor variations in colour, texture, and consistency may occur.

4. Ordering

  • Orders can be placed through our website or by contacting our sales team.
  • All prices are displayed per cube (m³) and exclude delivery unless stated otherwise.
  • We reserve the right to refuse or cancel any order due to stock availability, pricing errors, or suspected fraudulent activity.

5. Payment

  • Payment must be made in full through the provided secure payment methods.
  • No deliveries will be scheduled or dispatched until full payment has been received and cleared in our account.
  • We do not store your payment details; all transactions are handled securely by our payment processors.

6. Delivery, Access & Liability (Shipping Policy)

  • All deliveries are strictly governed by our Shipping Policy.
  • Kerbside Delivery & Risk: Standard delivery is strictly kerbside. If a customer or their representative explicitly requests or permits a heavy vehicle to enter the property boundaries, access is granted at the customer’s sole risk. Topsoil Tippers and its transport contractors accept no liability for damage to driveways, paving, underground utilities, gates, or surrounding structures.
  • Estate Restrictions: Customers in gated estates or restricted-access zones are solely responsible for verifying vehicle Gross Vehicle Mass (GVM) and axle-load limits prior to dispatch.
  • Failed Deliveries: If a delivery is denied access (e.g., at an estate gate) or cannot be completed due to inaccurate information, the customer will be liable for a failed delivery fee and any revised transport costs to re-dispatch the order.

7. Returns and Refunds (Returns & Refund Policy)

  • All cancellations, returns, and refunds are strictly governed by our Returns & Refund Policy.
  • Due to the physical nature of our bulk goods, we cannot accept returns once the product has been offloaded/tipped at your premises.
  • If you suspect a product is incorrect or defective upon arrival, you must notify the driver immediately before offloading. Any subsequent issues must be reported within 24 hours of delivery to qualify for an evaluation.

8. General Liability

  • Topsoil Tippers is not liable for any indirect, incidental, or consequential damages resulting from the use or storage of our products.
  • While we take all reasonable care to ensure product quality, we cannot guarantee specific outcomes for gardening, landscaping, or construction projects.

9. Intellectual Property

  • All content on this website, including images, text, and logos, is owned by Topsoil Tippers and may not be copied, reproduced, or distributed without explicit permission.

10. Changes to Terms

  • We may update these Terms and Conditions (including our integrated policies) at any time. Changes will be posted on this page with the revised date and will apply to all orders placed after the update.

11. Governing Law

  • These Terms and Conditions are governed by the laws of the Republic of South Africa and are subject to the jurisdiction of the courts in Pretoria, Gauteng.
